1. Acceptance of Terms

By accessing or using the coaching services, website, or client portal provided by AVIOR Athletics ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use our services.

2. Services

AVIOR Athletics provides personalized fitness coaching, nutrition guidance, and related consulting services. All services are educational and informational in nature. We are not a medical provider, and our guidance is not a substitute for professional medical advice, diagnosis, or treatment.

3. Not Medical Advice

You acknowledge that training and nutrition plans are recommendations only. You should consult with a physician before beginning any fitness or nutrition program, particularly if you have pre-existing health conditions. By using our services, you confirm that you have been cleared by a physician to participate in physical activity, or that you are voluntarily choosing to participate without such clearance.

4. Assumption of Risk

Physical activity and dietary changes carry inherent risks. You voluntarily assume all risk of injury, illness, or damage that may result from participating in any program or following any guidance provided by AVIOR Athletics.

5. Results Disclaimer

We do not guarantee specific results. Individual outcomes depend on personal effort, genetics, adherence, and other factors unique to each client. Statements regarding results are illustrative and not promises of future performance.

6. Client Responsibilities

You agree to:

• Provide accurate and complete information about your health and fitness
• Follow coaching guidance responsibly and within your physical limits
• Stop any activity that causes pain or discomfort and seek medical attention
• Notify us of any changes in your health status that may affect your program

7. Payment & Fees

Coaching services are provided under the service tier and pricing agreed upon at enrollment. Payments are processed securely through our payment provider. Unless otherwise stated, fees are non-refundable. Access to certain content (such as locked training plan sections) is granted upon confirmed payment.

8. Intellectual Property

All training plans, nutrition guidance, written content, and materials provided to you are the intellectual property of AVIOR Athletics. They are licensed for your personal, non-commercial use only. You may not reproduce, distribute, share, or resell any materials without our written consent.

9. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.

10. Limitation of Liability

To the fullest extent permitted by law, AVIOR Athletics and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our services or participation in any program. Our total liability shall not exceed the amount you have paid for services in the three months preceding any claim.

11. Cancellation & Termination

You may cancel your coaching engagement subject to the terms of your service agreement. We reserve the right to terminate or suspend services at any time, including for breach of these Terms, without refund for unused sessions if the breach is material.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms. We will notify active clients of significant changes via email.

13. Governing Law

These Terms shall be governed by the laws of the State of Colorado, United States, without regard to its conflict of law principles.

14. SMS Program

By opting in to AVIOR Athletics' SMS program, you acknowledge the following:

• Users opt in voluntarily.
• Message frequency varies.
• Message and data rates may apply.
• Reply STOP to unsubscribe.
• Reply HELP for assistance.

Opt-out is also available at any time via your profile settings.
